Welcome to Rolling Rome! These Terms of Service (“Terms”) govern your access to and use of Rolling Rome’s services, including our shoreline maintenance packages, equipment rentals, and other related services. By purchasing our services or using our website, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms. By accessing or using our services, you accept and agree to be bound by these Terms and any policies referenced herein. If you do not agree with any part of these Terms, you must discontinue use of our services immediately.

2. Services Provided. Rolling Rome offers a range of shoreline maintenance services, including but not limited to the Friendly Neighbor Package, Sand Slicer Package, RipRap Package, and Clearly Caribbean Package, along with equipment evaluation fees. These services are subject to availability and are detailed on our website.

3. Service Availability. Rolling Rome reserves the right to modify, discontinue, or refuse services to anyone at our sole discretion and without notice. While we strive to maintain consistent availability, certain factors such as weather conditions, equipment availability, or operational capacity may impact the provision of services.

4. Equipment Fee and Refunds. Customers using Rolling Rome’s services may be charged an Equipment Fee, refundable upon evaluation as outlined in our Return and Refund Policy. This fee applies unless the customer owns the necessary equipment (e.g., Beachroller, Sand Slicer). 5. Service Packages and Final Sale. All service packages are final sale, and no refunds or cancellations will be issued once the purchase is completed. Customers are responsible for selecting the appropriate service package based on their needs. Additional terms regarding refunds and package adjustments are outlined in our Return and Refund Policy.

6. Customer Responsibilities. Customers are responsible for ensuring the shoreline is accessible and safe for Rolling Rome personnel to perform services. Failure to provide safe access to the service area may result in cancellation or rescheduling of services, at Rolling Rome’s discretion.

7. Liability and Disclaimer of Warranties. Rolling Rome is committed to providing high-quality services but makes no guarantees regarding specific outcomes or results from the maintenance of shorelines. You agree to hold Rolling Rome harmless from any damages, including but not limited to property damage, personal injury, or environmental impacts, arising from the use of our services, except where such damages result directly from our gross negligence or willful misconduct.

All services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

8. Indemnification. You agree to indemnify and hold Rolling Rome and its affiliates, employees, contractors, and agents harmless from and against any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or in connection with your use of our services or breach of these Terms.

9. Modifications to Terms. Rolling Rome reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting to our website or upon notification to customers via email. Continued use of services after any modification constitutes acceptance of the updated Terms.

10. Governing Law. These Terms shall be governed and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin.
